General Terms and Conditions

These General Terms and Conditions (GTC) govern the sale of products via the webshop www.rubiomonocoat.at, operated by RMC Vertriebs GmbH.
By placing an order in our webshop or via remote communication tools, the customer accepts these GTC in their entirety. The online ordering process is legally binding.

1. Identity of the Seller – Customer Status

Any natural person who places an order in the webshop for a purpose that can be attributed neither to their commercial nor their independent professional activity is considered a "Consumer" (Customer) within the meaning of these terms. The contract language is German.

2. Scope of Application

These conditions apply to all offers from Rubio Monocoat, all orders from the customer, and all contracts concluded between Rubio Monocoat and the customer via the webshop, email, fax, or other remote communication means. Deviating terms and conditions of the customer are expressly rejected unless agreed upon in writing.

3. Ordering Process & Conclusion of Contract

All offers from Rubio Monocoat are non-binding and constitute an invitation to the customer to submit an offer. The purchase contract is only concluded upon written order confirmation from Rubio Monocoat or by the actual provision of the service. A mere order confirmation sent immediately after placing the order does not yet constitute acceptance of the contract.

4. Prices, Shipping Costs & Maturity

For consumers, the prices stated are final prices including statutory VAT and shipping costs. For entrepreneurs, prices are net prices excluding VAT, unless otherwise stated. The purchase price is generally due immediately upon ordering. In the event of late payment, statutory default interest will be charged.

5. Payment Methods & Retention of Title

The customer can choose the payment methods offered during the ordering process. The delivered goods remain the property of Rubio Monocoat until all claims from the contract have been paid in full. Prior to full payment, pledging or transfer by way of security is prohibited.

6. Shipping & Delivery

• Delivery is carried out to addresses within Austria.
• Shipping for items in stock generally takes place within 5 business days. Non-binding delivery dates serve as a guideline.
• If the customer is a consumer, the statutory provisions for the transfer of risk apply. For entrepreneurs, the risk passes to the customer upon handover to the carrier.
• Rubio Monocoat is entitled to make partial deliveries, especially if quantities are not immediately available in full.

7. Right of Withdrawal

Consumers have the right to withdraw from the contract within 30 days without giving reasons. The period begins on the day the customer (or a third party) takes possession of the goods.

To exercise your right of withdrawal, you must register your return online via your personal account. Please note that we don't accept return requests via email.

How to request a return:

1. Log in to your account on our website.
2. Navigate to "Orders" in your account menu.
3. Select the order containing the items you wish to return.
4. Click on "Request Return" and follow the prompts to complete your request.

Once your request is submitted, you will receive further instructions on how to ship the products back to us.

In the event of withdrawal, Rubio Monocoat will refund all payments received (including standard delivery costs) within 14 days of receiving the notification. The customer bears the direct costs of returning the goods.

8. Warranty and Liability

The statutory warranty provisions (2-year period) apply to consumers. Rubio Monocoat is not liable for property damage in cases of slight negligence. For entrepreneurs, the warranty period is 1 year, and defects must be reported in writing within 8 days. Liability for lost profits or consequential damages is excluded for entrepreneurs.

9. Applicable Law & Dispute Resolution

Austrian substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The EU Commission provides a platform for Online Dispute Resolution (ODR) at http://ec.europa.eu/consumers/odr. The place of performance is the registered office of Rubio Monocoat.
